1. Definitions

Unless otherwise specified, the capitalized terms shall have the meanings set out below:

Account means the user account created on the Site by a User in accordance with this Agreement, and which is registered with and approved by Lelo.rent.
Agreement means collectively these Terms and Conditions, the Privacy Policy, and any other terms and conditions mutually agreed between Lelo.rent and the User in relation to the Services.
Applicable Law means any statute, law, regulation, ordinance, rule, order, judgment, decree, by-law, or other governmental or regulatory requirement or restriction, whether interim or final, that is applicable to the subject matter of this Agreement, as may be in force in the relevant jurisdiction.
Broker means any individual or entity acting as an intermediary to negotiate or facilitate real estate transactions for a fee or commission, including property dealers, agents, or middlemen by whatever name called.
Computer Virus means any computer code, program, or malware that can destroy, damage, corrupt, overload, or impair the performance of any computer resource, including viruses, worms, trojan horses, spyware, or any other harmful or malicious code.
Confidential Information means all non-public information, whether spoken, printed, electronic, or in any other form, that relates to the business, operations, services, products, research, or customers of Lelo.rent or its affiliates. It includes but is not limited to business plans, methods, policies, financial information, technical information, software code, algorithms, User Information, trade secrets, know-how, and any other information marked or reasonably understood to be confidential.
Content means all data, text, graphics, images, information, and any other material available on or through the Site.
Government Authority means any national, state, municipal, or local government, any governmental, regulatory or administrative authority, agency or commission, or any court, tribunal, or judicial body with jurisdiction over the matter in question.
Information Technology Act means the Information Technology Act, 2000 of India, and the rules and regulations made thereunder, as amended from time to time.
Intellectual Property means all intellectual property and proprietary rights including patents, inventions, know-how, trade secrets, trademarks, service marks, logos, designs, copyrights, software (including source and object code), databases, and all other rights of a similar nature, whether registered or not.
Intellectual Property Rights means all current and future rights conferred by law in relation to Intellectual Property, including all applications and registrations, and the right to apply for registration, renewals, extensions, restorations, and accrued rights of action for past infringements in relation to any of the foregoing.
Lelo.rent (also referred to as the "Company") means Antmate Technologies Private Limited, a company incorporated under the laws of India, having its registered office at Ranka No-224, Sy No-80/3, 3rd Floor, Old Madras Road, Krishnarajapuram R S, Bangalore – 560016, Karnataka, India, including its officers, directors, employees, and representatives, and also refers to its platform provided via the Site.
Privacy Policy means the privacy policy of Lelo.rent, which is available on the Site, as may be amended from time to time.
Prohibited Conduct means the User's use of the Services or Site in a manner that is unlawful or prohibited by this Agreement or by Applicable Law. This includes, without limitation: (a) violation of third-party rights or any infringement of Intellectual Property Rights; (b) attempting to gain unauthorized access to the Site or related systems or networks; (c) engaging in any activity that is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable; (d) sending spam or unsolicited communications; (e) uploading or disseminating any viruses or harmful code; (f) "mirroring" or "framing" the Site or any content on any other server or device without authorization; (g) impersonating any person or entity, or falsely stating or otherwise misrepresenting an affiliation with any person or entity; or (h) any other activity that causes nuisance, annoyance, disruption, or inconvenience to Lelo.rent or any other Users.
Registration Data means the information provided by the User at the time of creating an Account, including name, mobile number, email address, username, and any other information required by Lelo.rent for registration.
Personal Information means any information that relates to an identified or identifiable individual, including but not limited to name, contact details, government-issued identification numbers (such as Aadhaar or PAN), financial information (such as bank account or payment card details), biometric data, or any other sensitive personal information.
Services means the services provided by Lelo.rent via the Site to Users within the territory of India, which include: (a) aggregating and listing real estate property information (such as rental properties) sourced from the internet and other sources; (b) providing a platform for Users (such as property owners and prospective tenants) to find and connect with each other for property rental transactions; (c) conducting limited verification or checks on property listings or User Information to improve authenticity; (d) providing tools for Users to post their own property listings or search for properties; (e) facilitating communication between Users (for example, by sharing contact information or messages through the Site); (f) displaying advertisements or promotions relevant to real estate services or other ancillary services; and (g) any other services that Lelo.rent may offer to Users from time to time.
Site means the website https://lelo.rent and any mobile applications or other online platforms through which Lelo.rent offers its Services, including all features, content, and services made available through such platforms.
Terms and Conditions means this Section I of the Agreement, which sets forth the terms and conditions governing the use of the Site and the Services.
Third Party Service Provider means any independent third-party service provider or partner that Lelo.rent may collaborate with or link to through the Site for providing additional or ancillary services (for example, movers and packers, payment gateways, background verification agencies, or any other service related to real estate transactions).
User (also referred to as "you" or "your") means any person who accesses or uses the Site and/or the Services for any purpose, whether as a property owner/listing provider, prospective tenant, or otherwise. This includes any person who registers an Account on the Site and any person browsing the Site without registration.
User Information means all information and data associated with a User, including Registration Data, Personal Information, and any content or information that the User uploads, posts, or otherwise shares on the Site or provides to Lelo.rent in connection with the Services.

2. Interpretation

In this Agreement, unless the context otherwise requires:

Any reference to a statute or law includes any amendments or re-enactments of such statute or law, and any rules or regulations made under it, to the extent applicable.
Reference to the singular includes a reference to the plural and vice versa, and reference to any gender includes all genders.
Headings and captions are for convenience only and shall not affect the construction or interpretation of any provision of this Agreement.
Reference to a "person" shall include any individual, company, firm, corporation, government, state or agency of a state, or any undertaking (whether or not having separate legal personality).
The terms "including", "include" or any similar expression shall be construed as illustrative and shall not limit the sense of the words preceding those terms.

3. Acceptance of the Terms and Conditions

By accessing or using the Site or Services, the User agrees to be bound by this Agreement (including these Terms and Conditions and the Privacy Policy). If the User does not agree with any provision of this Agreement, the User must refrain from using the Site or Services.
Each time the User accesses the Site or uses any Service, the User confirms their acceptance of the then-current version of the Agreement. This Agreement supersedes any prior agreements or arrangements between the User and Lelo.rent with respect to the use of the Site or Services.
The User represents and warrants that he or she is at least 18 (eighteen) years of age and is legally competent to enter into this Agreement. If a User is under 18, he or she may use the Site or Services only with the involvement and consent of a parent or legal guardian. Lelo.rent is not responsible for any consequence that arises from misrepresentation of age by a User.

4. Access to the Site

Users may browse certain areas of the Site without creating an Account. However, to access or use some of the Services (such as posting a property listing, saving preferences, or contacting other Users), the User will need to register and create an Account by providing the required Registration Data.
Users must provide accurate and current User Information during the registration process, and keep their Account information updated. Lelo.rent may verify the email address or phone number provided by the User (for example, via a one-time password or verification link) to activate the Account.
Each User is allowed to create only one Account using a unique mobile number and email address. Creating multiple accounts by the same User or impersonating another person is strictly prohibited. Lelo.rent reserves the right to monitor for multiple accounts and may suspend or terminate duplicate or fake accounts at its sole discretion.
The User agrees to cooperate with Lelo.rent's staff or automated systems as needed for any verification of User Information or Account authentication processes.
Lelo.rent reserves the right to refuse registration or access to the Site to any User if it suspects that the User has provided false information, is in violation of this Agreement, or for any other reason that Lelo.rent deems appropriate for safeguarding its platform and Users.

5. Subscription Plans and Fees

Some Services or features on the Site may be available under paid plans or subscriptions (“Subscription Plans”). The details of available Subscription Plans, including the scope of Services, duration, and applicable fees, will be provided on the Site. By subscribing to a Subscription Plan, the User agrees to pay the fees associated with that plan.
All fees paid for Subscription Plans are non-refundable, except as expressly provided otherwise (for example, under a specific money-back guarantee plan if offered on the Site). Users are advised to carefully review the features and terms of a Subscription Plan before subscribing.
Lelo.rent reserves the right to change the fees or introduce new fees for any Service or Subscription Plan at any time, at its sole discretion. Fee changes will be posted on the Site or communicated to Users via the email address provided in their Account. The User's continued use of the Services after the fee change constitutes the User's agreement to pay the updated fees.
If any taxes (including goods and services tax or similar indirect taxes) are applicable on the fees for Services or Subscription Plans, the User agrees to pay such taxes in addition to the stated fees.

6. User Information and Content

The User is solely responsible for the accuracy, authenticity, and completeness of the User Information and any content that the User provides or uploads on the Site. Lelo.rent does not endorse any User Information or content, and shall not be liable for any errors or omissions in any content posted by the User or any other third party on the Site.
The User grants Lelo.rent a non-exclusive, worldwide, royalty-free license to use, store, reproduce, modify, adapt, publish, translate, distribute, and display any User Information or content (in whole or in part) that the User posts or provides through the Site, for the purpose of operating, promoting, or improving the Services. The User represents that he or she has all necessary rights to grant this license for any content submitted.
Lelo.rent is not responsible or liable for the deletion, loss, or failure to store any User Information or content, and the User is advised to maintain backup copies of any information or content provided to the Site.
Lelo.rent reserves the right (but has no obligation) to monitor, review, remove, or disable access to any User content at its sole discretion, at any time, without notice to the User, if such content is found to be or is reasonably suspected to be in violation of this Agreement or any Applicable Law, or is otherwise objectionable. This includes the right to remove or edit listings, posts, or messages that contain inappropriate or prohibited content, or to terminate Accounts that repeatedly post such content.
Lelo.rent may maintain records of User Information and communications (including any verification documentation provided by Users) as required by Applicable Law or for purposes of internal administration and security. However, Lelo.rent is not obligated to permanently retain any User Information or content once the purposes for which it was collected have been fulfilled or if the User or content is no longer active on the Site.
Lelo.rent shall have the right, but not the obligation, to verify any User Information provided by the User, including by contacting third parties, using publicly available information, or requiring additional documentation. The User agrees to cooperate with such verification efforts. Lelo.rent disclaims any liability for errors, omissions, or inaccuracies in User Information, whether arising from third-party verification or otherwise.

7. Rights of Lelo.rent

Lelo.rent reserves the right to suspend, deactivate, or terminate any User's Account or access to the Site, at any time and without prior notice, if the User is found or suspected to be in violation of this Agreement or any Applicable Law, or if Lelo.rent deems such action necessary to protect its interests or those of other Users. Such suspension or termination may include the removal of the User's listings or content.
Lelo.rent may, at its sole discretion, implement measures to detect and prevent misuse of the Site (including but not limited to detecting the creation of multiple accounts, fraudulent listings, or Brokers attempting to use the Site in violation of its intended use). If any misuse or unauthorized activity is detected, Lelo.rent has the right to take appropriate action, such as disabling accounts or blocking access, without any liability.
Lelo.rent retains the right to modify or discontinue, temporarily or permanently, the Site or any Services (in whole or in part) with or without notice. This includes changing the layout, design, features, or functionalities of the Site, introducing new Services, or discontinuing existing Services. Lelo.rent shall not be liable to the User or any third party for any such modification, suspension, or discontinuance of the Site or Services.
While Lelo.rent will endeavor to provide advance notice to Users of any scheduled maintenance or downtime of the Site (for example, for upgrades or repairs), Lelo.rent is under no obligation to do so. Lelo.rent will also make reasonable efforts to ensure that any disruption of Services is resolved as soon as practicable, but it does not guarantee uninterrupted availability of the Site or Services.
Lelo.rent reserves the right to send Users informational, transactional, or promotional communications in relation to the Services. By using the Site, Users consent to receiving such communications via email, SMS, notifications on the Site, or other contact information provided. Users may opt out of receiving promotional communications at any time by following the unsubscribe instructions provided in such communications or by contacting Lelo.rent customer support. However, Users may still receive transactional or account-related messages (for example, OTPs, account alerts, etc.) even after opting out of marketing messages.

8. European Union Data Protection Rights

If the User is a resident of the European Union or otherwise subject to the EU General Data Protection Regulation (GDPR), the following rights shall apply, subject to Applicable Law:

Right to Know and Access: The User has the right to know what personal data of theirs is collected and how it is used, and to access personal data that Lelo.rent holds about them.
Right to Rectification: The User has the right to request correction of inaccurate personal data and to have incomplete personal data completed or updated.
Right to Deletion (Right to be Forgotten): The User has the right to request the deletion of their personal data when it is no longer needed for the purposes for which it was collected, or if processing such data is unlawful, subject to Lelo.rent's legal obligations to retain certain data.
Right to Data Portability: The User has the right to request a copy of the personal data they have provided to Lelo.rent in a structured, commonly used, and machine-readable format, and to transmit that data to another data controller where technically feasible.
Right to Restrict Processing: The User has the right to request that Lelo.rent restrict the processing of their personal data under certain circumstances (for example, if the User contests the accuracy of the data or if the processing is unlawful and the User opposes deletion).
Right to Object: The User has the right to object, on grounds relating to their particular situation, to the processing of their personal data if such processing is based on legitimate interests of Lelo.rent or is for direct marketing purposes.
Right to Withdraw Consent: Where Lelo.rent relies on the User's consent to process personal data, the User has the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

Users who wish to exercise any of the above rights may do so by contacting Lelo.rent at the email address provided in the Privacy Policy or the Grievance Officer contact in these Terms. Lelo.rent will respond to such requests in accordance with Applicable Law. Please note that these rights are not absolute and may be subject to certain exemptions or limitations under GDPR. Additionally, these rights may only apply to Users in jurisdictions where they are provided by law.

9. Unauthorized Access and Account Security

The User is responsible for maintaining the confidentiality of their Account login credentials (username and password) and for all activities that occur under their Account. The User agrees to immediately notify Lelo.rent of any unauthorized use of their Account or any other breach of security. Lelo.rent will not be liable for any loss or damage arising from the User's failure to comply with this provision.
The User shall ensure that they exit or log out from their Account at the end of each session, especially when accessing the Account from a public or shared device. Lelo.rent further encourages Users to use a strong and unique password for their Account and to update it periodically to enhance security.
In the event of any unauthorized access to or use of a User's Account, Lelo.rent may, upon receiving notice from the User or upon its own detection, temporarily suspend or lock the Account to prevent further unauthorized activity. Lelo.rent will assist the affected User in restoring access to their Account as feasible, including by issuing new credentials or requiring a password reset, once the circumstances have been reviewed. However, Lelo.rent shall not be liable for any unauthorized transactions or activities conducted through the User's Account prior to such notice to Lelo.rent.
Notwithstanding Lelo.rent's security measures, the User acknowledges that no system is completely secure. By using the Site, the User accepts the inherent security risks of providing information online and will not hold Lelo.rent responsible for any breach of security unless it is due to Lelo.rent's gross negligence or willful default.

10. Use of Information and Privacy

Lelo.rent will collect, use, store, and share User Information in accordance with its Privacy Policy and Applicable Law, including the Information Technology Act, 2000 and rules thereunder. By using the Site or Services, the User consents to such processing of their information.
The User authorizes Lelo.rent to use their User Information for the following purposes:
1. Providing and improving the Services to the User, including processing inquiries, displaying listings, facilitating communications between Users, and customizing the User experience.
2. Sharing relevant details with other Users or third parties when necessary for providing the Services (for example, sharing a property owner's contact information with a prospective tenant once a User indicates interest, or vice versa), in accordance with the Privacy Policy.
3. Contacting the User about Service-related announcements, alerts, or communications, including verification codes, transaction confirmations, technical and security notices, and administrative messages.
4. Sending promotional materials or advertisements to the User concerning Services or features of the Site, or relating to third-party services that are relevant to the User's interests (unless the User has opted out of such communications).
5. Disclosing User Information to third-party contractors or service providers who work on behalf of or with Lelo.rent to provide the Services, such as customer support, technical services, payment processing, or analytics, subject to obligations of confidentiality and data security.
6. Disclosing User Information to government authorities or law enforcement officials if required to do so by law or if, in Lelo.rent's reasonable belief, such disclosure is reasonably necessary to (1) comply with legal obligations, (2) respond to legal process or requests for information, (3) enforce this Agreement, (4) respond to claims that any content violates the rights of third parties, or (5) protect the rights, property, or personal safety of Lelo.rent, its Users, or the public.
Lelo.rent may, from time to time, integrate or offer additional services provided by Third Party Service Providers to Users through the Site (for example, services such as packers and movers, payment gateways for rent payments, or background verification services). If the User chooses to use such services, the User authorizes Lelo.rent to share the necessary User Information with the relevant Third Party Service Provider solely for the purpose of providing the requested service. The User's use of any third-party service is subject to that provider's terms and privacy policy, and Lelo.rent does not guarantee or assume liability for third-party services.
The Site may include third-party advertising or marketing content. Third-party advertisers or ad networks may use cookies or similar technologies to collect information about the User's browsing behavior on the Site in order to show tailored ads that are more relevant to the User. By using the Site, the User consents to the placement of cookies and similar technologies in their browser by Lelo.rent and third parties in accordance with the Privacy Policy. The User may adjust their browser or device settings to remove or block cookies, but some parts of the Site might not function properly if cookies are disabled.
Lelo.rent may also send tailored in-application or email advertisements or messages to Users. Users can opt out of marketing or promotional emails by using the unsubscribe link in such emails. However, as noted, opting out of tailored advertising does not completely block advertisements; the User may still see generic ads or receive essential communications about the Services.
The User acknowledges that any information shared via the Site (including in any public forums or listings) becomes accessible to other Users and third parties, and that Lelo.rent cannot control the use of such information by others. The User should not share personal or sensitive information through public content on the Site that they would not want to be publicly available.

11. Platform Usage and User Responsibilities

The User acknowledges that Lelo.rent is an intermediary platform that enables Users to access aggregated property listing information and to connect with each other for real estate transactions. Lelo.rent itself is not a property owner, real estate broker, or agent, and it does not own, sell, resell, furnish, rent, or control any of the properties listed on the Site. The responsibilities of Lelo.rent and Users in this context are as follows:

User Discretion: Users are solely responsible for evaluating and selecting properties and other Users (landlords, tenants, etc.) to interact with. Lelo.rent merely facilitates the availability of information and contact between Users. Any decision to enter into a rental or lease agreement, or any other real estate transaction, is made by the Users at their own risk and discretion.
No Endorsement or Guarantee: Lelo.rent does not endorse, guarantee, or make any representation about any User, property, or third-party service (such as moving services or loan offers) that may be accessible through the Site. Any profile previews, recommendations, or listings presented to the User are for information purposes only and do not constitute an endorsement by Lelo.rent of those Users or properties.
Information Accuracy: Information about properties and Users on the Site may be obtained from multiple sources, including public databases, other websites, or directly from Users. Lelo.rent does not warrant that such information is up-to-date, accurate, or complete. While Lelo.rent may perform basic verification or checks on listings (for example, verifying if a listing is currently active or flagging duplicates), it does not guarantee the authenticity of any listing or User identity. Users should independently verify any details important to their decision (such as property condition, legal ownership, RERA registration status, etc.) before proceeding with any transaction.
User Interactions: Any interactions, communications, or transactions between Users (including between landlords and prospective tenants) are solely between those Users. Lelo.rent is not a party to any agreement (verbal, written, or implied) between Users, and it does not mediate or resolve disputes between Users. In the event of any dispute or conflict between Users (for example, relating to property viewings, payments, terms of lease, etc.), the Users must resolve the issue amongst themselves. Under no circumstances will Lelo.rent be liable for any loss, damage, or inconvenience arising from or related to interactions between Users.
Third-Party Services: If the Site provides contact information or links to third-party service providers (such as movers, cleaners, payment processors, or loan providers), this is provided merely for the convenience of Users. Lelo.rent does not guarantee or take responsibility for any services provided by such third parties. Any arrangement or contract for services between a User and a third-party service provider is strictly between the User and that third party, and Lelo.rent shall not be liable for any issues or damages arising from such services.
User Diligence: Users are advised to exercise due diligence and take appropriate precautions in all interactions and transactions. This includes verifying the identity and credentials of other Users or service providers, inspecting properties in person before making payments, using written agreements for any transaction, and complying with all legal requirements (such as rent agreements being properly executed and registered, if applicable). Lelo.rent may provide guidelines or tips for safe dealings, but the responsibility to follow these and to engage in safe practices rests with the Users.
No Guaranteed Outcomes: Lelo.rent does not guarantee that Users will successfully find a property or tenant, or that a property will be rented or sold by using the Site. Lelo.rent is not responsible for the inability of Users to contact each other, for any User's lack of interest, or for transactions that do not materialize or complete. Users should be aware that while Lelo.rent endeavors to provide a useful platform, the outcome depends on many factors beyond Lelo.rent's control.

12. Content Guidelines and Prohibited Content

Users must use the Site responsibly and are forbidden from posting or transmitting any content that violates this Agreement, third-party rights, or Applicable Law. Without limiting the generality of the foregoing, Users agree not to:

Unauthorized Access: Attempt to gain unauthorized access to any portion or feature of the Site, any other systems or networks connected to the Site, or to any server, computer, network, or to any of the Services offered on or through the Site, by hacking, password mining, or any other illegitimate means.
Infringement of Rights: Upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party, unless the User is the owner of the rights or has the necessary permission to use such content.
Objectionable Material: Upload, post, or transmit any information or material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, including any material that exploits or harms minors in any way.
Spam and Unsolicited Communications: Transmit or send any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation. Users should not use the contact information of other Users for any purpose other than connecting regarding genuine property inquiries.
Malicious Software: Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Site or another's computer or digital device.
Disruption of Services: Interfere with or disrupt the operation of the Site or the servers or networks that host the Site, or disobey any requirements, procedures, policies, or regulations of such servers or networks.
Commercial Exploitation: Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or Services for any commercial purposes not explicitly authorized by Lelo.rent. This includes using the Site's content or User listings to operate a competing service or to generate mailing or contact lists for commercial use.
Data Mining: Use any robot, spider, scraper, site search/retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index any portion of the Site or any content posted on the Site for any purpose without the express written permission of Lelo.rent.
Impersonation and False Information: Impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age, or your affiliation with any person or entity. This includes falsely stating that you represent a certain company or have an endorsement that you do not actually possess.
Illegal Activities: Use the Site or Services to promote or conduct any activity that is illegal or violates any Applicable Law, including but not limited to fraud, money laundering, or gambling.

Lelo.rent reserves the right to report any violations of this Section to law enforcement authorities and to cooperate with them in any resulting investigations or prosecutions. Users found to be engaging in any Prohibited Conduct or posting Prohibited Content may have their Accounts terminated and may be banned from future use of the Site, in addition to any legal consequences under Applicable Law.

13. User-Generated Content and Listings

The Site may allow Users to create, submit, post, and share content, including property listings, profile information, reviews, feedback, and other materials (collectively, "User-Generated Content" or "UGC"). The following terms apply to such content:

Ownership and License: Lelo.rent does not claim ownership of UGC submitted by Users. However, by submitting UGC on the Site, the User grants Lelo.rent a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, copy, modify, distribute, publish, and process the UGC for the purposes of operating the Site and providing Services. This license survives termination of this Agreement only for the duration necessary for Lelo.rent to fulfill any legal or archival obligations and to remove the content from any public displays.
No Pre-Screening: Lelo.rent generally does not pre-screen UGC and is not responsible for the views or opinions expressed by other Users on the Site. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by Users are those of the respective author(s) and not of Lelo.rent. Lelo.rent does not guarantee the validity, accuracy, or usefulness of any UGC.
Prohibited Content: Users must ensure that their UGC does not contain any Prohibited Content as outlined in Section 12 (Content Guidelines) of these Terms. Lelo.rent reserves the right to remove or disable any UGC that violates these Terms or any Applicable Law, or for any other reason it deems fit, without prior notice to the User responsible for such content.
User Liability: The User who posts any UGC is solely responsible for that content. The User shall ensure that no confidential or personal information is posted in UGC unless they intend such information to be public. The User agrees to indemnify Lelo.rent for any claims arising from UGC that the User provides, as set out in the Indemnity section of these Terms.
Feedback: If a User provides feedback, suggestions, or ideas regarding Lelo.rent or the Services ("Feedback"), the User acknowledges that such Feedback is not confidential and that Lelo.rent may freely use this Feedback for any purpose, including improving the Site or Services, without any compensation to the User.

14. Intellectual Property Rights

Ownership by Lelo.rent: All Intellectual Property in and to the Site and the Services (excluding User-Generated Content as defined above), including but not limited to text, graphics, logos, button icons, images, audio clips, databases, and software, is owned by or licensed to Lelo.rent. Lelo.rent retains all rights, title, and interest (including Intellectual Property Rights) in the Site and Services. The User is granted a limited, revocable, non-transferable, and non-exclusive right to access and use the Site and Services for personal, non-commercial purposes in accordance with this Agreement. No other rights are granted or implied.
Respect for Third-Party Rights: Lelo.rent respects the Intellectual Property Rights of others and expects Users to do the same. Users shall not upload, post, or transmit any content on the Site that violates the Intellectual Property Rights of any third party. If a User repeatedly infringes the Intellectual Property Rights of others, Lelo.rent may terminate or suspend the User's Account at its sole discretion.
Restricted Use of Site Content: Users shall not use any content from the Site (other than content that the User has posted) for any purpose without obtaining the prior written consent of Lelo.rent or, as applicable, the rightful owner of such content. In particular, Users shall not use or reproduce any content obtained from the Site for commercial purposes, publish or distribute it on other platforms (online or offline), or create any derivative works based on it, without explicit permission.
Prohibited Exploitation: Any attempt by a User to collect, use, copy, or exploit any content (including property listings or User Information) on the Site in order to provide the same or a similar service as Lelo.rent, or to derive any commercial benefit, whether directly or indirectly (for example, by acting as a real estate broker or agent using information from the Site without authorization), is strictly prohibited and may result in immediate termination of the User's Account and legal action.
User License to Lelo.rent: By submitting any User Information or content (including property listings, images, descriptions, etc.) to the Site, the User grants to Lelo.rent a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, adapt, modify, publish, translate, create derivative works from, distribute, and display such content in connection with the Services and Lelo.rent's business, including for marketing and promotional purposes. The User represents and warrants that they have sufficient rights to grant this license for any content submitted and that such use by Lelo.rent will not infringe any third-party rights.
Legal Action: Lelo.rent reserves the right to pursue legal action and remedies to the fullest extent permitted by law against any User who infringes Lelo.rent's Intellectual Property Rights or the Intellectual Property Rights of others through the use of the Site or Services.

15. Platform Security and Technical Risks

Security Measures: Lelo.rent employs reasonable and appropriate security measures to protect the Site and its systems from unauthorized access, cyber-attacks, and other vulnerabilities, in accordance with industry best practices. However, Lelo.rent does not guarantee that the Site will be secure or free from bugs, viruses, or other vulnerabilities.
User Precautions: The User is responsible for configuring their information technology, computer programs, and platform in order to access the Site. Users should use their own virus protection software and take regular backups of data to protect against viruses or other destructive code encountered through the internet or the Site.
No Liability for Attacks: Lelo.rent shall not be liable for any loss or damage caused by viruses, distributed denial-of-service attacks, or other technologically harmful material that may infect the User's computer equipment, computer programs, data, or other proprietary material due to the User's use of the Site or to the User's downloading of any content from the Site or from any websites linked to the Site.
No Warranty on Software: The User understands that the use of the Site involves the transmission of data over networks that are not owned or controlled by Lelo.rent, and therefore Lelo.rent cannot ensure any data transmitted or received through the Site is secure and free from unauthorized access. Lelo.rent provides the Services "AS IS" and "AS AVAILABLE" without any warranties of any kind related to technical performance.
Operational Disruptions: In no event shall Lelo.rent be liable for any failure or delay in the performance of the Site or Services resulting from system outages, server downtime, or technical failures, including any problems beyond Lelo.rent's control (such as internet service provider failures, hosting service outages, power failures, or force majeure events described elsewhere in this Agreement).

16. Disclaimers

The User expressly understands and agrees to the following disclaimers regarding the Services and Site:

No Professional Advice: All information on the Site, including property listings, pricing, availability, and other data, is provided for general informational purposes only. Lelo.rent is not a real estate broker, financial advisor, or legal advisor. Nothing on the Site should be construed as professional advice (including legal, real estate, or financial advice) on which the User should rely. Users are encouraged to seek professional advice independently before making any decisions related to real estate transactions.
Information Provided "As Is": Lelo.rent makes reasonable efforts to ensure that information on the Site is accurate and up-to-date. However, the Site and all content, information, and Services provided are on an "AS IS" and "AS AVAILABLE" basis. Lelo.rent does not warrant or guarantee the accuracy, completeness, or usefulness of any information on the Site. Any reliance the User places on such information is strictly at the User's own risk.
Interactions and Transactions: Lelo.rent is not a party to any rental agreements or other transactions between Users. Lelo.rent has no control over and does not guarantee (i) the existence, quality, safety, or legality of any listed property; (ii) the truth or accuracy of any listing, descriptions, or other content provided by Users; (iii) the ability of landlords to lease a property or of tenants to pay rent; or (iv) that any transaction will be completed. Lelo.rent shall not be responsible for any breach of a rental agreement or any disputes arising between Users.
User Identity and Verification: While Lelo.rent may implement basic verification procedures for User accounts or listings (such as verifying phone numbers or email addresses), Lelo.rent does not guarantee the identity of any User or the accuracy of any User Information. Users are responsible for verifying the identity and credentials of other parties they deal with and for exercising caution in their dealings. Lelo.rent will not be liable for false, misleading, or fraudulent information provided by any User.
Third-Party Links and Services: The Site may contain links to third-party websites or services for the convenience of Users (for example, links to mapping services, loan providers, or service professionals). Such third-party sites and services are not under the control of Lelo.rent, and Lelo.rent is not responsible for their content, offerings, or privacy practices. The inclusion of any link does not imply endorsement by Lelo.rent. Accessing or using third-party sites or services is at the User's own risk and subject to the terms and conditions of those third parties.
No Warranty: Lelo.rent disclaims all warranties, express or implied, in connection with the Site and Services, to the fullest extent permitted by law. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Lelo.rent does not warrant that the Site or Services will meet the User's requirements, that the operation of the Site will be uninterrupted or error-free, or that defects will be corrected.
Limitation of Liability for Content: Lelo.rent is not responsible for any User-Generated Content or listings on the Site, nor for any actions or omissions of Users. The User acknowledges that Lelo.rent is an intermediary and, as such, is protected by applicable laws regarding intermediary liability (such as Section 79 of the Information Technology Act, 2000 in India) which provide that Lelo.rent is not liable for third-party content or communications posted by Users, provided Lelo.rent complies with applicable requirements.
Force Majeure: Lelo.rent shall not be held liable for any delay or failure in performance of any part of the Services to the extent that such delay or failure is caused by factors beyond Lelo.rent's reasonable control, including but not limited to acts of God, natural disasters, pandemics, civil or military disturbances, acts of terrorism, strikes, labor disputes, governmental actions, outages of electrical, telecommunications or internet services, or any other similar events.

17. Limitation of Liability

To the fullest extent permitted by Applicable Law:

Lelo.rent (including its officers, directors, employees, and agents) shall not be liable to the User for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, goodwill, opportunity, data, or other intangible losses, arising out of or in connection with the User's access to or use of, or inability to access or use, the Site or Services, even if Lelo.rent has been advised of the possibility of such damages.
Lelo.rent's total aggregate liability for any and all claims arising out of or relating to this Agreement or the User's use of the Services shall not exceed the amount actually paid by the User to Lelo.rent in the 6 (six) months immediately preceding the event giving rise to such claim, or INR 1,000 (Indian Rupees one thousand), whichever is greater. If the User has paid no amounts to Lelo.rent for the use of any Services, Lelo.rent shall have no liability towards the User.
The limitations of liability in this Section apply to all causes of action, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.
Nothing in this Agreement shall limit or exclude liability for gross negligence, fraud, intentional misconduct, or for death or personal injury caused by negligence, or any other liability to the extent such liability cannot be excluded or limited under Applicable Law.

18. Indemnification

The User agrees to indemnify, defend, and hold harmless Lelo.rent, its parent company (Antmate Technologies Private Limited), affiliates, and their respective officers, directors, employees, and agents (collectively, the "Indemnified Parties"), from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including reasonable attorney's fees and court costs) that arise out of or in connection with:

The User's use or misuse of the Site or Services, or any content the User posts on the Site.
The User's breach or alleged breach of this Agreement, including any violation of the representations, warranties, and covenants made by the User herein.
Any allegation that any content that the User submits or transmits through the Site infringes or misappropriates any Intellectual Property Rights or other rights of any third party.
Any dispute, claim, or issue between the User and any other User or third party (including a property owner, tenant, broker, or service provider) that arises from connections or agreements made through the Site.
The User's violation of any Applicable Law or the rights of a third party in the course of using the Site or Services.

Lelo.rent reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User, in which event the User will cooperate with Lelo.rent in asserting any available defenses. The User shall not settle any such claim or matter without the prior written consent of Lelo.rent. The obligations under this section shall survive termination or expiration of this Agreement.

19. Compliance with Real Estate Regulations

Lelo.rent operates as an information intermediary in the real estate sector and expects Users to comply with all Applicable Laws, including any real estate regulatory laws and rules:

Awareness of RERA: If applicable, Users should be aware of the Real Estate (Regulation and Development) Act, 2016 (RERA) and corresponding state-specific real estate regulations. Certain properties, particularly new developments, may be required to be registered with the relevant state RERA authority. Lelo.rent does not independently verify whether each property listed on the Site is in compliance with RERA or other regulatory requirements. Users are advised to verify the registration and approvals of properties as necessary and to consult the relevant RERA website or authority for information on any property listing of interest.
No Endorsement of Listings: Lelo.rent does not endorse any property listing on the Site, nor does it certify that a property or project has obtained requisite approvals or registrations. The presence of a property listing on the Site does not imply that Lelo.rent or Antmate Technologies Private Limited has verified or confirmed the legal title, regulatory approvals, or compliance of such property. Users must conduct their own due diligence or seek professional advice regarding the legal and regulatory compliance of any property they are interested in.
Liability for Non-Compliance: Each User (whether property owner, broker, or developer) is solely responsible for ensuring that their listings and transactions comply with all Applicable Laws, including RERA and local housing regulations. Lelo.rent shall not be liable for any fines, penalties, or legal action taken against a User due to non-compliance with any real estate laws or regulations. If Lelo.rent becomes aware of any listing that is in violation of Applicable Law, it reserves the right to remove such listing and take appropriate action against the responsible User.

20. Grievance Redressal and Contact Information

If a User has any grievances, questions, or concerns regarding the Site, Services, or this Agreement (including any discrepancies or misuse of information), the User may contact the designated Grievance Officer of Lelo.rent (as per the Information Technology Act, 2000 and rules made thereunder) through the contact details provided below:

The Grievance Officer shall acknowledge the User's complaint within 24 (twenty-four) hours and dispose of such complaint within a period of 15 (fifteen) days from the date of its receipt, taking appropriate action in accordance with Applicable Law. In case of any issues involving cybersecurity or any unlawful content, Users are encouraged to provide all necessary details to assist in investigation and resolution.

Additionally, law enforcement officials or any authorized government authorities seeking information or wanting to report any cyber security incidents may contact Lelo.rent at the email address provided above. Lelo.rent will respond to or cooperate with such requests as required by law.

21. Miscellaneous

Waiver: No failure or delay by Lelo.rent in exercising any right, power, or remedy under this Agreement shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy by Lelo.rent preclude any other or further exercise of that or any other right, power, or remedy. Any waiver, to be effective, must be in writing and signed by an authorized representative of Lelo.rent.
Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable by any court or authority of competent jurisdiction, such provision shall be deemed to be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, that provision (or the offending part) shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of this Agreement, which shall remain in full force and effect.
Assignment: The User shall not assign or transfer any of their rights or obligations under this Agreement to any third party without the prior written consent of Lelo.rent. Lelo.rent may freely assign, transfer, or subcontract this Agreement or any of its rights or obligations hereunder to any third party, including in connection with a merger, acquisition, sale of assets, or by operation of law.
Entire Agreement: This Agreement (together with the Privacy Policy and any other terms expressly incorporated herein) constitutes the entire agreement between the User and Lelo.rent regarding the subject matter hereof, and supersedes any prior or contemporaneous understandings and agreements between the parties regarding such subject matter. The User acknowledges that no reliance is placed on any representation made but not expressly contained in this Agreement.
Amendments: Lelo.rent may update or modify this Agreement (including any policies, such as the Privacy Policy) at any time at its sole discretion. If Lelo.rent makes any material changes to this Agreement, it will post the updated Agreement on the Site and may provide notice to Users via email or through the Site. It is the User's responsibility to review the Terms and Conditions periodically. The User's continued use of the Site or Services after any changes to this Agreement signifies acceptance of those changes.
Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to the provisions of arbitration below, the courts located in Bengaluru, India shall have exclusive jurisdiction to hear and decide any dispute arising out of or in connection with this Agreement, and the User and Lelo.rent hereby irrevocably submit to the jurisdiction of such courts.
Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved amicably through negotiations between the User and Lelo.rent. If the dispute is not resolved through negotiations within 30 (thirty) days from the date one party notifies the other of the dispute, then such dispute may, at the election of either party, be referred to and finally resolved by binding arbitration in Bengaluru, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by Lelo.rent, and the language of arbitration shall be English. The award of the arbitrator shall be final and binding on the parties. Notwithstanding the foregoing, Lelo.rent reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction to prevent misuse of the Site or to protect its Intellectual Property Rights or Confidential Information.
